State Superintendent Message Regarding CDE Case and Student Data - Parental Opt-out Information

In April 2012, two organizations, the Morgan Hill Concerned Parents Association and the Concerned Parent Association, filed a lawsuit against the CDE alleging widespread, systemic non-compliance by local education agencies with special education laws. The suit also alleges the CDE fails to monitor, investigate and correct such non-compliance in accordance with the law. The CDE denies these allegations and is actively defending the litigation.

The Milpitas Unified School District was not involved in the lawsuit and is not the subject of any of the suit’s allegations. Nonetheless, as a part of this lawsuit, the CDE has been ordered by the United States District Court to release all data it has collected on general and special education students since Jan. 1, 2008. None of this information may be used outside the context of this lawsuit; no student’s identifying records will be disclosed to the general public.

Our District is committed to helping families stay informed about this issue and empowered to protect their children’s data.  Parents and guardians who do not wish for their students’ information to be disclosed may complete and mail in an “opt-out form” to prevent the release of student date, the form is available at this link: 
http://www.cde.ca.gov/re/di/ws/documents/form2016jan26.pdft.  The form must be mailed by April 1, 2016.

En abril del  2012, dos organizaciones, la Asociación de Padres Preocupados de Morgan Hill y la Asociación de Padres Preocupados,  presentaron una demanda en contra del CDE alegando dispersión, incumplimiento sistemático por parte de las agencias locales de educación de leyes especiales de educación. La demanda también alega que el CDE falla en monitorear, investigar y corregir dicha falta de incumplimiento de acuerdo con la ley. El CDE niega estas acusaciones y defiende activamente el litigio.
 
El distrito escolar unificado Milpitas no estuvo involucrado en la demanda y no es objeto de ninguna de las alegaciones de la demanda. No obstante, como parte de esta demanda, el CDE ha sido ordenado por el Tribunal de Distrito de Estados Unidos de liberar los datos de los estudiantes de educación general y especial, desde el 1 de enero de 2008. Ninguno de estos datos se puede utilizar fuera del contexto de esta demanda; ninguno de estos registros de identificación estudiantil  será divulgada al público en general.
 
Nuestro distrito está comprometido a ayudar a las familias a mantenerse informado acerca de este tema y capacitados para proteger los datos de sus hijos. Los padres y tutores que no deseen que la información de su estudiante sea revelada podrá completar y enviar por correo una "forma opt-out" (optar fuera) , para evitar la liberación de dicha información. El formulario está disponible en este link: http: //www.cde .ca.gov / re / di / ws / documentos / form2016jan26.pdft. La forma debe ser enviada el 1 de abril del 2016.
