State Superintendent Message Regarding CDE Case and Student Data - Parental Opt-out Information

2/17/2016

In April 2012, two organizations, the Morgan Hill Concerned Parents Association and the Concerned Parent Association, filed a lawsuit against the CDE alleging widespread, systemic non-compliance by local education agencies with special education laws. The suit also alleges the CDE fails to monitor, investigate and correct such non-compliance in accordance with the law. The CDE denies these allegations and is actively defending the litigation.

The Milpitas Unified School District was not involved in the lawsuit and is not the subject of any of the suit’s allegations. Nonetheless, as a part of this lawsuit, the CDE has been ordered by the United States District Court to release all data it has collected on general and special education students since Jan. 1, 2008. None of this information may be used outside the context of this lawsuit; no student’s identifying records will be disclosed to the general public.

Our District is committed to helping families stay informed about this issue and empowered to protect their children’s data.  Parents and guardians who do not wish for their students’ information to be disclosed may complete and mail in an “opt-out form” to prevent the release of student date, the form is available at this link:
http://www.cde.ca.gov/re/di/ws/documents/form2016jan26.pdft.  The form must be mailed by April 1, 2016.

For more information visit:
http://www.cde.ca.gov/re/di/ws/morganhillcase.asp or contact the California Department of Education at (916) 319-0800.

_________

Important Message: “Santa Clara County Children’s Health Assessment!”

2/3/2016

During the State of the County Address in January 2015, President Dave Cortese called on the Santa Clara County Health and Hospital System to conduct a new assessment of the health of children in our county. A child’s health plays a vital role in their development throughout their lifetime. Today’s children are the future community leaders, elected officials, and workforce in Santa Clara County. The information we learn through this assessment will help us provide what our children need today to achieve their full potential in the future.

Just a few minutes of your time can help make Santa Clara County a healthier place for all children.
The Santa Clara County Public Health Department is conducting a survey to find out about the health needs of the children in Santa Clara County. The survey will begin from February through May 2016. If you receive a phone call or letter from the Public Health Department, please PARTICIPATE!

All information provided is confidential. If you have any questions about the survey, please visit www.sccphd.org or contact The-Vu Nguyen from the Office of Supervisor Dave Cortese at 408-299-5030 or the-vu.nguyen@bos.sccgov.org.

Notice: Please help us to forward this message to everyone on your email list, and post it on all the online forums. Once again, thank you for your help and support in making this county a healthier place for all children.
