SCHOOL IMPACT (DEVELOPER) FEES

The Milpitas Unified School District (MUSD) collects fees, authorized by Education Code Section 17620, on residential and commercial construction within the boundaries of MUSD. The purpose of the fees is to provide adequate school facilities for the students of MUSD. The fees are used to finance construction and reconstruction.
 
MUSD is currently collecting Level I fees. The Level I fees provide a statutorily designated level of fees that districts may assess if they are able to support them through a justification study. Level I fees are subject to an inflationary increase to be authorized by the State Allocation Board (SAB) in every even year. (Government Code Section 65995)
 
MUSD Developer Fees were approved by the MUSD Board of Education on March 12, 2024 and will go into effect on March 13, 2024. The next adjustment will be in 2026.
 
Fee Payment
The amount of the assessable square footage within the perimeter of a residential structure and of the chargeable covered and enclosed space within the perimeter of a commercial or industrial structure shall be calculated by the City Building Department in accordance with the City’s building standards. The District shall issue a Certificate of Compliance to the applicant only after the applicable developer fees are paid to the District. The applicant must provide the District’s Certificate of Compliance to the City Building Department before the City will issue a building permit.
 
To Process and Pay Your Developer Fees:

  1. Email a copy of your plans/blueprints to nagraz@musd.org. The plans/blueprints should include the Architect’s square footage summary confirmation that has been approved by the City Building Department, the property address and the name of the builder and/or homeowner. In the email, please include your phone number.
  2. After your plans have been received, an application for Certificate of Compliance will be emailed and you will be notified of the total amount due. An appointment will be scheduled to come to the District Office to make payment and receive the Certificate of Compliance to take to the City for your project.
  3. Please make check or money order payable to “Milpitas Unified School District” or “MUSD”. We do not accept cash or credit card payments.
  4. If unable to email, please call Naomi Agraz at (408) 635-2600 x6022 to schedule an appointment. At the time of appointment, please bring in your plans/blueprints to be copied and your payment. Complete the application for Certificate of Compliance at the appointment to receive the Certificate of Compliance.

Residential Development at $5.17 per sq. ft. Assessable Space
Residential construction, including manufactured homes and mobile homes, five dollars and seventeen cents ($5.17) per square foot of assessable space. “Assessable space” means all of the square footage within the perimeter of a residential structure, not including any carport, covered or uncovered walkway, garage, overhang, patio, enclosed patio, detached accessory structure, or similar area. If the addition is 500 sq. ft. or more of assessable space, fees are charged on the entire addition. For Accessory Dwelling Units (ADU), if the square footage is 750 sq. ft. or more of assessable space, fees are charged on the entire amount of assessable space.
 
Commercial/Industrial Development at $0.84 per sq. ft. Assessable Space
Commercial or industrial construction, eighty four cents ($0.84) per square foot of chargeable covered and enclosed space. “Chargeable covered and enclosed space” means the covered and enclosed space determined to be within the perimeter of a commercial or industrial structure, not including any storage areas incidental to the principal use of the construction, garage, parking structure, unenclosed walkway, or utility or disposal area.
